Terms of Sale
Last updated: 11 October 2026
1. Who we are
Cerqueira Gomes Photography is run by Miguel Cerqueira Gomes, a self-employed photographer based in Porto, Portugal. Address: Rua José Gomes Ferreira, 50, 4150-441 Porto, Portugal. Tax number (NIF): 223 990 990. Email: cerqueiragomes.photography@gmail.com.
2. The prints
Every print is made to order on Hahnemühle fine art paper: 100% cotton, acid-free and archival. The paper for each photograph (Photo Rag 308, Photo Rag Baryta 315 or Museum Etching 350) is chosen together with our print lab.
Sizes refer to the image itself. Each print has a white border, 2 cm on the 20×30 and 3 cm on larger sizes, so a 40×60 cm print comes on a 46×66 cm sheet. Prints are sent unframed.
Fine Art prints are an open edition. Limited Edition prints are numbered, hand-signed and come with a certificate of authenticity. The edition size for each photograph and size is shown on its page, and no more prints than that will ever be made of that photograph at that size.
Screens differ in brightness and colour, so a print will not match every screen exactly. Every file is checked for colour accuracy before printing.
3. Prices and payment
Prices are in euros and are the final price of the print. VAT is not charged: the seller is exempt under article 53 of the Portuguese VAT Code (CIVA).
Shipping is charged per order and depends on the destination and on the largest print in the order. You choose the destination in the cart, and the shipping cost is shown there and on the payment page before you pay. The current rates are listed in our FAQ.
Payment is made by card through Stripe. We never see or store your card details.
4. How to order, and when the contract is made
To order, choose a photograph and its size (open edition or, where offered, Limited Edition), and add it to your cart. In the cart you choose where to ship, and you can review your prints, the shipping cost and the total, remove prints, or go back and change them. When you press Checkout you are taken to Stripe's secure payment page, where you enter your email, address and card details; everything can be checked and corrected there before you press Pay.
The contract is made when your payment is completed. You are then shown your order reference, and we send you a confirmation email with the details of your order and a link to these terms. We keep a record of every order; you can ask us for a copy at any time. We suggest you save or print these terms for your records, since they may be updated for future orders.
These terms are also available in Portuguese (Termos de Venda), with the same content. If the two versions ever differ, the one more favourable to you applies. We do not subscribe to any code of conduct.
In the rare case that a print cannot be produced (for example, the last copy of an edition was bought by someone else at the same moment), we will contact you and refund you in full.
5. Production and delivery
Each print is made to order and shipped within 10 to 15 business days of your order, as one tracked parcel. Every print is shipped rolled, in a rigid tube. Open edition prints are usually sent directly by our print lab; Limited Edition prints are sent by us after signing.
If your print has not been delivered within 30 days of your order, you may cancel it and receive a full refund.
We ship to Portugal (including the Azores and Madeira), Spain (mainland and Balearic Islands), Austria, Belgium, Denmark, Finland, France, Germany, Greece, Ireland, Italy, Luxembourg, the Netherlands and Sweden. We do not ship to the Canary Islands, Ceuta or Melilla, which are outside the EU VAT area; an order placed for those addresses will be cancelled and refunded in full. For other EU countries, write to us for a quote.
6. Returns: your right of withdrawal
You may return a print within 14 days of the day you receive it, without giving any reason.
To do so, let us know by email at cerqueiragomes.photography@gmail.com within those 14 days, with a clear statement that you are returning it. You can use the model form below, but you do not have to. Then send the print back to us within 14 days of telling us; we will reply with the return address. The cost of sending it back is yours. Please pack it carefully, ideally as it arrived, and use a tracked service.
We will refund everything you paid, including the shipping cost, within 14 days of the day you told us, using the same payment method and at no cost to you. We may hold the refund until the print has arrived back or until you have sent us proof that you have posted it, whichever comes first.
You are only responsible for any loss of value caused by handling the print beyond what is needed to look at it (for example framing, trimming or marking it); in that case we may deduct that loss from the refund.
Prints made to your own specifications, such as a custom size or another special request agreed with you, cannot be returned under this right.
A returned Limited Edition print keeps its number and may be offered again.
Model withdrawal form
To Cerqueira Gomes Photography, cerqueiragomes.photography@gmail.com:
I hereby give notice that I withdraw from my contract for the sale of the following print(s): [title, size, order reference].
Ordered on [date] / received on [date].
Name: [your name]. Address: [your address].
Date: [date].
7. Damaged or defective prints
Every print is covered by the legal guarantee of conformity (3 years from delivery, under Portuguese law).
If the parcel looks damaged on arrival, refuse the delivery or, if you accept it, note the damage with the carrier and keep the packaging. If a print arrives damaged, tell us as soon as you can, ideally within 7 days, with a photo of the print and of the packaging, so we can also claim from the carrier. We will send you a new print or refund you, at no cost to you. This does not limit your legal rights in any way.
8. Photographs of people
Some of these photographs were taken in public places and show people. If you recognise yourself in one of them and would prefer it not to be sold, write to us and it will be withdrawn from sale.
9. Copyright
All photographs are © Miguel Cerqueira Gomes. Buying a print gives you ownership of that physical print, not the right to copy, publish or otherwise reproduce the photograph.
10. Complaints and disputes
If something is not right, please write to us first at cerqueiragomes.photography@gmail.com.
You can also file a complaint in the electronic complaints book (Livro de Reclamações Eletrónico).
In case of a dispute, consumers may turn to an alternative dispute resolution entity: CICAP, Centro de Informação de Consumo e Arbitragem do Porto. More information is available on the Portal do Consumidor.
If you live in another EU country, the European Consumer Centre Portugal gives free help with cross-border disputes.
11. Applicable law
These terms are governed by Portuguese law. This does not take away any protection you have under the mandatory consumer law of the country where you live.
